I hate *this version* of tariffs with a passion. National security, contain China, targeted enforcement? Sure, absolutely. 

Crappy global "reciprocal" (with a fake and dumb calculation of the trade deficit) tariffs? Puke. 

But, as a lawyer, I have a lot of thoughts on *how* the Court rules against him and that matters. For instance, Trump has other tarriff tools, so it's not like the end of them unless they really go full-bore. And only a subset of them are under IEEPA (which you have to tell as IIIIEEEEEPPPPPAAAAA btw, it's tradition)

Other countries have closed their door to US products for too long, while swamping us with theirs unchecked. I don't mind other countries swamping us with products, mind you, but not while their doors are closed to ours

Relieved. This feels clearly like something that should not be in the hands of a single (and in this case particularly economically illiterate) person. 

I think there is some need for a president to do these sort of things, but it should be severely limited. A broad base tax on a major chunk of the world is not limited. 

I’d love to see Congress get together to narrow this power and specifically put a time limit on the ‘emergency’ powers before congressional approval is needed. 

Force Congress to do their job.

I think there is a very good argument that congress never intended a President to do what Trump is doing. Under major questions doctrine that would make it illegal absent direct congressional mandate.

He probably could have gotten away with it going slowly and hitting individual countries with trade barriers and calling out those trade barriers. Instead, he just calculated the trade deficit and used it as proof the entire world had trade barriers against us. Declaring a nonnegotiable 10% tariff on all goods from all countries and going up from there doesn't seem inline with intent.

I wouldn't be happy about it, but I don't think they will find them invalid. If they did, I believe it would destroy our country. The stock market would fall 5k points overnight. The President has the power to halt all imports from coming into the country if he wanted to do it, so why wouldn't he have the power put a tariff on those same goods? I really believe they're going to rule in his favor on this one.

2) If they restrict his use of the  International Emergency Economic Powers Act (IEEPA) he will find a different justification. He has multiple options.

Trump is right in that it’ll decide if we’re a third world country or not.  If the Supreme Court, unelected and allegedly unpolitical, uphold one of the most basic constraints of our constitution, no taxation without representation, we survive.  It’s the last bastion that should be insulated from Trump.  Republican congressmen have already shown they have no spine to stand up as a check against Trump.

TLDR: Trump caused the fed to print money, and wall street is soaking it up.   
  
Trump is responsible for the skyrocket stock market. But it's not for the reason he is touting. 

He kicked off skyrocketing deficits during his first term which caused the fed to print even more money, which is being injected directly into the top of the stock market, instead of into the actual economy. 

It's divorcing the stock market further from average every day people and since it's the only metric that he is paying attention to, he isn't likely to take any steps to prevent the crash that will also wipe out the stock market.

As much as Republican voters deserve the tariffs it will be great if the Supreme Court does this. While they allowed it to go on far too long, and the damage is already pretty well done to our world position, we can at least slow and stem our decline by walking them back.


I'll take the delay in suffering. And hopefully (but not likely) we'll figure out how to fix all of this when we can.

I’ve been saying this for a while: a loss in the tariff case is the best thing that could happen to Trump. It undoes a lot of a huge self-inflicted injury, lets him take credit for things improving, and ALSO gives him a scapegoat if things go badly (“we’d be doing so much better if the court hadn’t gone rogue and struck down the tariffs”)

He'll keep fighting to implement tariffs through other means, which will increase the salience of the issue and keep it in the news cycle. What if he pressures the Republicans in congress to pass more tariffs themselves or legislation that more grants more tariff authority to the president? Now he's tying the rest of the GOP more clearly to this unpopular issue, or better yet, engaging in intraparty fighting over it.
